Ajay TG granted bail after 90 days in detention

Ajay TG Dear friends,
So there is good news for all of us. Ajay TG was granted bail today, however, the release will happen tomorrow. Today Chandra Kumar Kashyap Judicial Magistrate First Class, Durg District, granted bail to Ajay today the 4th of August around five pm. The bail was granted under sec 167 (2) (a) (i), which is called statutory bail in local parlance. Since the ninety days had expired and the police had not furnished the charge sheet thus the magistrate who was authorising the detention had to grant him bail.
During the remand hearing on 2nd of August morning the police took further remand for the 12th . The bail had been applied for on 2nd evening itself at 4.45 pm as the ninety days period was over at 5pm. Since the court asked for the case diary it was slated for Monday morning. Today Ajay’s two friends Dilip Ingley and Bose Thomas were there when the matter got listed and the order was reserved for the evening when they were joined by Ajay ’s lawyer Mahedra Dubey and Advocate Sudha Bharadwaj. The order after stating why bail was being granted also stated the conditions under which he would be released. They are
Ajay will furnish a personal bond of fifty thousand rupees.
Two sureties of Rs. 25,000 each.
On affidavit he will give a list of the movable and immovable property he has.
Every 2nd Monday of the month he will give his attendance in the local police station.
He will not move out of the country without the permission of the Court.
While the two sureties (condition 2) was prepared in advance it was condition (3) which has caused the delay in the release. The Court has asked the lawyers of Ajay to take the notary public to the jail tomorrow morning and get the list of property signed and notarised after which he will be released.

We hope this is the beginning of good news for Ajay TG. Will keep all of you informed of the developments.

AS CHHATTISGARH POLICE FAILS
TO FILE THE CHARGE SHEET
Today the Judicial Magistrate (First Class), at Durg District Court in Chhattisgarh granted bail to Mr. Ajay T G, a film-maker and member of the State Executive Committee of Chhattisgarh PUCL, who was detained under the draconian law called The Chhattisgarh Special Public Security Act 2005.
The Chhattisgarh Police failed to file the Charge Sheet in the case during the mandatory 90 days. After completion of 90 days on 2nd August, 2008, the lawyers moved bail application u/s 167(2) of the Criminal Procedure Code. The matter was heard today, and in the evening the Bail was granted to Ajay TG. However, he is likely to be released only tomorrow, because of technicalities involved. Instead of filing the Charge Sheet, the police took 10 days remand on 2nd August, 2008.
During the hearings, Adv K Bose Thomas (Former Member, State Executive Committee, CG PUCL), Adv Dalip Ingle, represented Ajay T G. Adv Sudha Bhardwaj (Member, State Executive Committee, CG PUCL), and Adv Mahindar Dubey, were also present in the Court, along with family and friends of Ajay TG.
The failure of the Chhattisgarh Police to file the Charge Sheet in Ajay TG’s case is to be viewed against the backdrop of concerted campaign where Ajay himself, and the CG PUCL have been claiming that he has been falsely implicated only to target human rights activists like Ajay TG, and also organisations like the People’s Union for Civil Liberties, which have carried on a systematic struggle for preservation and promotion of human rights in Chhattisgarh. PUCL would study the implications of the case, and seek further legal action.
The CG PUCL is of the view that the case of Dr. Binayak Sen (it’s General Secretary, and National Vice-President) should be reviewed by an independent agency, and subsequently withdrawn as the prosecution has, so far, not been able to establish its case, at all.
It may be worth mentioning here, that the Director General of Police (DGP), Chhattisgarh, Mr. Vishwaranjan had met Ajay TG on 19th July, 2008, in person. According to the reports appearing in a section of the press, it appears that the State Government is contemplating withdrawing the case against Ajay TG. In that context, the meeting of the highest police official with Ajay TG, while in judicial custody, carries some significance. However, it is only Ajay TG would be able to reveal the nature and content of this meeting.

    It is a regret that we in independent India have to see such gross human rights violation as in the case of Dr.Binayak Sen or others.These laws are condemnable and must be revoked. Union home minister Mr. Sibraj Patil, in an interview to TIMES NOW was stating that they are very sincere to be careful about individual’s human rights.To combat terror they do not want any mistake to take place that may hurt civilians or can be used wrongfully against any citizen of India.I just hope that he and the establishment will remember their duty to democracy and humanity in such cases.This is not a good sign yet.

    Ajay TG is only one event. Injustice in middle India , the whole of India rather, are a process. My earnest request to all of you to be more aware of the problems.
    I wish all the best to Ajay and Dr Binayak Sen and all those marginalised people they have been rooting for. May better sense prevail on Mainstream India.
