“A case has been filed against Aishwarya Rai and Hrithik Roshan, owing to their gutsy on-screen kiss in Sanjay Gadhvi’s Dhoom 2.
Alleged as an “obscene sequence”, the atypically Bollywood lip-lock has got Hrithik and Ash into legal trouble.
The case was filed in the court of judicial magistrate first class R. K. Batham by advocate Shailendra Dwivedi under Sections 292 (vulgarity) and 509 (derogatory to women) of the Indian Penal Code.
As Dwivedi’s complaint has it, women have felt offended after watching the scene as it has promoted vulgarity in the society, especially among the youth.”
Going by the gross receipts of Dhoom 2, half of India has legitimately and illegitimately (cable/dvds) has seen the film.
So by now Indian society has become vulgar, men and women are having sex on the street, teenagers are going around raping women, men, animals or any hole in the wall they can poke, and the women who saw the film were so badly offended that they have committed suicide.
So thus is born a new superhero, stronger than Krissh whose name is Shailendra Dwivedi who will now safeguard the Indian citizens from the offensive kiss.
We have had several such superhero crusaders, infact Shiv Sena saved all Indian men, lest their women turn lesbians by watching Fire, so they safe guarded the society by burning down posters etc. Statistics show that the lesbian population jumped 100% overnight. My Brother Nikhil unfortunately didn’t ire them as no Indian man or party seems to have an objection to men turning gay by watching the said film and the women were happy that their men would leave them alone. Or maybe their rationale was that since the main protagonist was gay he was punished by God by giving him HIV and hence it took care of future ‘offenders’. I use the word offenders because till date ‘anal sex’ is punishable by the Indian Penal Code!!!
I like the concept of testing labs. By that example, I also like our censor board.
When they saw Paanch and decided to ban it, I wonder what happened to those 6 men and women? Did you ever wonder? I’m asking this because their reasons for banning Paanch was that it will destroy the moral fiber of our society because it shows the main protagonists using drubs, drinking, smoking and killing! Did those members who saw the film, start using drugs, smoking, drinking or killing?
I think there should be a law against those assholes who take out such stupid and idiotic cases.
Feroz Khan shot with a chimpanzee and tiger for Janasheen in Thailand. A guy in Allahabad filed a case against him saying he violated the PETA act and used animals in his films! There is word that a PETA person will also sit in the censor board. Ashutosh Gowariker while shooting his film Akbar Jodha has to suffer the publicity hungry animal rights societies along with publicity hungry Rajput welfare society. Before Mangal Pandey released his village woke up in protest saying Mangal Pandey never drank and how can he be showing going into a mujra.
When Milind Soman and Madhu Sapre posed with a python, when Dino and Bipasha Basu did the Calida ad, angry women rights organizations burned effigies in protest! Next thing you know these morons with political allusions will be destroying our caves or clothing them.
The Government of India very happy decides to give us the status of an industry, but what perks does it give us, none to do with technology transfer, taxes on stock, except for exempting multiplexes from Entertainment tax for 5 years so that they can overcharge consumers, they have done nothing for the film industry. Fuck the economic part of it, atleast they can come up with a law to stop these idiotic lawsuits! At least they can keep their esteemed misters in check who want to implement to most IDIOTIC ideas to keep out smoking on screen. Next will don’t show corrupt ministers, policemen, liquor, rape, violence, animals, and a dress code for men and women on screen.
In the early 50’s there was a moral code in Hollywood where kissing was not allowed, then when kissing was permitted it was only for a total 3 seconds, so someone would sit with a watch and time it, dialogue would be written within the kiss, so that they could keep kissing and talking thus enabling the lovers to kiss longer.
They later had a unspoken ban on black actors kissing white actresses, but a white actor could kiss a black actress ‘Will Smith claims he was banned from kissing Cameron Diaz on screen because of American racism. The actor said Hollywood panders to the nation’s problem of seeing a black man and white woman getting intimate and stopped the co-stars kissing in new movie Hitch. To avoid controversy, Smith says he smooched Latin beauty Eva Mendes instead.
When Heath Ledger and Jake Gyllenhaal kissed in Brokeback Mountain, even the films publicists milked it to the core, because another Hollywood taboo of two men kissing was broken.
In earlier decades the same logic required Jewish actors to submerge and hide their ethnicity. What kind of world do we live in? Why do people in the movie business have to be answerable to anyone except for what is on the movie screen. The paying public has the right to say ‘good’ film, ‘bad’ film but not to judge a personality as a person! Rs 150 or $6 don’t give anyone that right.
The argument that they are in films so they are in the public eye and public figures is is today used by viewers, once this was an excuse of journalists who indulged in ‘yellow journalism’. Today there is no term left called yellow journalism, its mainstream film journalism.
The difference between a politician and a film personality is simply this, we elect a politician to work for us, our taxes pay his salary and the money he gets to spend on us, so he is answerable to us for his actions or lack of actions, a film personality and sportsmen have today become idols because we don’t have good society leaders. Which means ‘us’, ‘we’ are so rotten that we seek someone better than us?
Are we so weak as a society? Are we so rotten within? Do we need someone to tell us what to do? What to buy? What to eat? When to sleep? How to do things? What is right? What is wrong?

The world goes on just the same, sex is awesome, sex is heaven and nobody has the right to come between two consensual adults, on screen and off.
Maybe we should send a get well soon card to all these organizations, individuals and political parties, who want to protect our sensibilities, our maybe we should kiss them instead!

Much before cinema started in India Widow marriage was settled by Vidya Chandra Sagar and there was no law that Censor could stop Ramesh Sippy if He wishes to keep Jai Alive and marrying widow Radha!!!!
Ramesh Sippy himself in 1971 had directed and produced film Andaz where widow Hema Malini is shown to marry again.
Long before Sholay was even conceptualise or even Ramesh Sippy finished his schooling, films were made in Hindi cinema where a widow married again.
Remarrying widow was never a question of law in India in 20th century

In this country – you can vote at 18, drink at 18, get married at 21 – officially. You can also make mms clips at 15, get laid at 14, get drunk and drive at 16, rape a girl at 17, watch porn on the net at 14! HMMMMM! Oh, maybe the censor board and every other guardian of morality is still not working hard enuff!! Maybe some more burning of shops at valentines day, lynching of lovers, protests outside cinema halls and some more PILs will put us in line!
I keep thinking why the censor board is so bereft of any shred of sanity? The people who sit on the board can release some films but ban others – case in point – some big budget films are banned for “corrupting the youth of today” – but half a dozen b grade films are released showing worse scenes of violence, drugs and lots of sex! has anyone seen a film called – Fun can be dangerous or Bobby( the new one) or shaadi ke baad or ladies tailor or gunda or jungle ki raani? Black friday was a hard hitting and brilliant film that was banned for all the wrong reasons. I have seen it and loved it. So was water, so was fire, so were a lot of other films that faced the ire of the pseudo brigade. Even a satire like kissa kursi ka had to face the anger of the congress party in the 70s. The problem is the immaturity of these people who will never grow up!
As for our new protector – our saviour – Shailendra Dwivedi – well he has got his 15 seconds of fame. God save us from such great thinkers!

Sophocles was cleared by the Censor Board after making a change in the publicity ‘based on a true story’. It was in response to notices issued to them on a petition filed by a group of 1993 bomb blast accused seeking a ban on the screening of the film. The application was filed by 36 incarcerated accused in the blast case who were being represented by advocate Farhana Shah and senior lawyer Majeed Memon.
Thus Black Friday was stopped from release on the day of its premiere!!!
Hopefully now that judge Kode will have given everyone sentencing the film will finally release

Perhaps producer (Mid Day) of Black Friday was little adament on putting a tag on film that BF is based on true story. When case is pending in court how can you give your verdict? Film screening can be a kind of public canvassing and that might have been the points attached with tussle between censor board and producers of BF. If I am right they exonrated certain gangsters in BF and a very large section of India feels they had something to do with the case. Indian scene is very sensitive in some fields. Sadly, that stress of producer on putting tag of truthness stopped people to judge BF as a film.
About Black Friday (although I loved the film!) the stay is completely justified since its genuinely wrong to accuse someone until they are convicted.Its dangerous.
Suparn,yeah actually a Sholay CD that I picked up in Malaysia has this ending where Thakur manages to “saap ke tarah kuchal diya” to Gabbar. Was a bit surprised to see this ending, but later on heard that the original ending that was re-shot.
Maybe someday when I hit bad times, I will auction that CD on eBay for a fortune. :d

Suparn a wonderful post!! The censor board should not be given the power to block the film from coming out. Instead they should just give the ratings A, U etc or should create a special rating if possible. May be a something like ‘E’ for educated people only:)
Abroad (US)there is a rating ‘NC17′ for films which are too graphic can be released only on DVDs and tapes may be satellite. Only few films have been put in this category.
Its also rediculous that a film maker has to get clearance from animal welfare(Maneka Gandhi and gang) folks. The requirement for Animal welfare(God know what they r called) are so freaking stupid. If theres an animal used there is a requiremnt of a doctor and has to be fed for certain # of time and proved to them. A complete song from RDB had to be cut I heard coz of that. The film was even shown to the Air force people and had to get their approval before release. So that means there could be any no. of screening /approval levels that a film maker has to undergo.
People like us are at such a loss of not getting to watch films like ‘Panch’ and not able to see brilliant work :(

Something has to be done with PETA too….I remember reading somewhere about the movie Godavari(telugu)…where Sekhar Kammula had shot the whole movie with the dog sequence and the movie is in the final stages of Post Production….enter Blue Cross!!!! Ruk Jaoo…Stop what you are doing right now…You cannot show a dog being happy in the movie..you cannot show real dogs in the movie..else i am gonna sit outside u r house with a danda….Poor guy had to shell “X” lacs of rupees for the dog sequence at the last moment…and that can be easily seen in the movie..the hurry-burry- kinda graphics…

They seem to be on a roll…making money even after making shit after shit. Got miserable headache watching it. They are just milking the brand yashraj. There is a movie here in the US that just came off the festival circuit, “This Movie Is Not Yet Rated”. Big topic of conversation among my friends and I when it was first released. It raises many of the same points that were raised here. The ratings board here in the US is made up of anonymous individuals who are tasked with rating movies based on community sensibilities. They are not related to the film industry. Thus, ratings are subjective.
Sounds like this is an issue everywhere. Except, the Indian Censor Board sounds more nefarious. Here, even a non-porn movie that would be rated X can be released with no rating in the art house theaters. If there is a screen and an audience, it will be released. I understand trying to protect a society’s sensibilities, but does it make sense to prevent the release of a film?
And, this lawsuit just stinks of a publicity ploy.
If I had to list my five hottest, steamiest, sexiest scenes in a movie, three of them are from Indian films. No kissing, no nudity, just a song or a dance or a look…While I don’t agree that a kiss will destroy a culture, I do think that the implied sexuality of Indian film is much sexier and hotter than the overt sexuality of Western films….

Movies, film makers, actors etc are easy targets. It dosent matter how ludicrous the complaint the court hears it, the news channel makes it BREAKING NEWS! and the people behind the people who make the complaints begin getting their mileage.

Holy crap this is such a great fn website! No offense to your background Suparn but this is a much better site for industry folk than Rediff Movies (which, as an aside, I think of late has been overdosing on the same old uninteresting BS about Shilpa’s Big Brother adversities and Shahrukh emerging as the next Alex Trebec – yes, I am Canadian and we do celebrate Alex Trebec day with much joy and trivia).
Point is this was a wicked article. Being neutral I find Americans tend to underplay their overdoses of sex and violence while Indians go overreact to just about anything which they so hypocritically deam as unacceptable.
When the hell are people going to come to grips with the laws of audience and purpose? A maker will target his film to a certain audience: if you don’t like it, then it wasn’t meant for you. Simple.
On a side note I have to to say that, as derivitave as it was, I enjoyed Ek Khiladi Ek Hasina (though I still think you could’ve cast better than Koena Mitra considering it was a title part).

I agree with you about the stupid lawsuits that are filed by the dozen by publicity seekers. I differ on the point about animal rights, though. For years, filmmakers have got away with mindless and unnecessary cruelty to animals in the course of filming. Do some research on animals used in films… you will be horrified! For example, they would stitch up the lips of tigers and lions that were being featured in films. We as viewers never got to see that side of it. We just thought those were such heartwarming films about the animal world! Sure, the activists kick up a huge fuss these days, but, if you think about it, it was the film industry’s responsibility to put some norms into practice for the use of animals in films. But, as in industry, they have always been interested in only one thing… profits. That’s why it seems like the Animal activists are getting too vocal. And this is a completely different ball game from frivolous lawsuits about kissing and the like.
BTW, there is no such thing as a “PETA Act” in the Indian Constitution. It is actually the Prevention of Cruelty to Animals Act, and is pretty comprehensive. And the proposal is to have a member of the Animal Welfare Board of India to witness the shoot of Akbar-Jodha. Its a pretty good proposal, and, if you think about it, will save the producer and crew a lot of trouble in future. Remember, Suparn, this is the Law of India we are talking about, and not just someone’s whims.
Just for information, PETA is an international NGO that works for the protection of animals, and have had an Indian branch in Juhu for the last few years. Many in the Indian film Industry are supporting their work. Check them out… they are really fun, committed people. I’ve learnt a lot from them.

Nice, passionate post. We are all aware about the evils of censorship and fight it in whichever ways we can. I am totally anti-censorship and pro-absolute-freedom-of speech. I wish, however, that you hadn’t spoken of mindless / politically motivated censorship and the absolutely imperative animal rights activism in the same breath.
